Election Rules

**2008 Nomination of Election Process Board of Directors Tenants’ Association Pelican Resort Club (T.A.P.R.C.)

A) All qualified members (owners in good standing) of the Pelican Resort Club (PRC) are eligible to seek nomination and election to the TAPRC Board of Directors.

B) Procedure based on pertinent articles of the Association:

1.- Board members shall be appointed at the Annual General Meeting on December 2 and 3, 2008 in St. Maarten.

2.- Individuals who are qualified members and who have received the written support of at least seventy -five (75) additional qualified members shall be deemed to be nominated for appointment to the Board.

3.- Upon the expiration of the terms of three (3) of the current members of the Board, three (3) elected Candidates shall serve for a term of two (2) years.

4.- Further voting instructions based on pertinent articles of the Association shall be included in the ballot material to be sent to PRC owners.

C) Additional Procedural Information:

1.- Candidates who meet the requirements set forth herein shall be placed on the election ballot to fill three (3) vacancies of the Board of Directors, TAPRC. The election will be held at the Annual General Meeting of the TAPRC on December 2 and 3, 2008 in St. Maarten.

2.- Voters for the election of the Board of Directors shall cast one vote per week owned at the PRC for each of the three (3) positions to be filled. 2  weeks owned = 2 votes for each of the 3 positions to be filled, equaling 6 votes, etc.

3.- The final date for placing candidates on the election ballot is Monday, August 25, 2008.

4.- In order to ensure uniform qualification standards throughout the nomination and election process, write-in candidates will not be accepted and there will be no nominations from the floor at the Annual General Meeting.

5.- Candidates may send their petition form to the Pelican Resort Club, for posting in the Pelican Sales Office, for the purpose of acquiring owner signatures to meet the requirement for attaining nominee status.

6.- In order to maximize dissemination of information relative to the nomination and election process and to encourage broad owner participation, PRC owners are requested to “pass the word” via every means of communication available.

D) Candidate Criteria:

1.- Each candidate for a Board position must present to the Pelican Board of Directors, no later than Monday, August 25, 2008, a notarized statement or written certification from ISCO relative to their status as a qualified owner.

2.- Seventy -five (75) signatures of qualified owners are required of new and incumbent candidates. For the purpose of verification, signatures must be discernible. Names must be legibly printed next to the signatures. The owners’ contract number(s), unit number(s) and calendar week(s) of ownership are also required. See  2008 Nomination Ballot.pdf

3.- Each of the successful candidates for placement on the election ballot shall be required to submit answers to the specific inquiries appearing on the form entitled “Candidate Background Information Form.

4.- Candidates written petition or other documents containing the information required above must be received by the Board no later than Monday, August 25, 2008.

5.- Following of the completed forms, the forms will be enclosed in the Notice, Proxy Statement and Proxy for the 2008 Annual General Meeting.

6.- The planned date for mailing election ballots to owners is on or before Monday, October 6, 2008. An addressed envelope will be provided for mailing the election ballots.

7.- Voters requiring additional ballots should photocopy the ballot provided.
